We reserve the right to substitute a comparable or superior vehicle at no extra cost to the hirer where unforeseen circumstances dictate. This shall not constitute a breach of contract and shall not entitle you to any refund.
Should you decide to downgrade your vehicle from that originally booked you will be entitled to 50% refund in the rate difference.
6. Rental Refusal
7. Driver’s Licence
A valid full driver’s licence (national or international) is required for each nominated hirer and must be presented prior to or at the time of hire.
8. Minimum/Maximum Age
9. Use of the Vehicle
- A person who is not identified on the rental agreement
- A person who is not licensed
- A person whose blood alcohol concentration exceeds the lawful percentage
- A person who has given or for whom you have given false details
- A person whose driver’s licence has been cancelled or suspended within the last three years
- To carry persons for hire or reward
- To carry explosive or corrosive materials
- To propel or tow any vehicle, trailer, boat or other object
- To carry any greater load and/or more persons than is lawful or in a manner or for a purpose other than those for which it was designed and constructed
- For racing, pacemaking, reliability trials, speed trials, hill climbing or for the purpose of being tested in preparation for use for any of those purposes
- In a dangerous or careless manner
- For any illegal purpose
- In violation of New Zealand road rules
10. Self-Contained Certification
- All campervans are provided with a self-contained certificate.
- You must ensure that the toilet is emptied and clean prior to returning the vehicle otherwise a charge of $150 will apply.
- All grey and black water must be emptied at appropriate dump stations/areas prior to return of vehicle.
11. Living and Camping Kits

16. Booking, Deposits, Cancellation and Payment
- Up to 7 days prior to vehicle collection no refund will be given.
- Between 8 – 21 days prior to collection – 20% deposit and 80% of remaining balance will be retained by ARV
- Between 22 – 28 days prior to collection – 20% Deposit and 50% remaining balance will be retained by ARV
- Between 29 – 45 days prior to collection – 20% Deposit and 20% of remaining balance will be retained by ARV
- More than 45 days prior to pick up – The 20% deposit can be used as a credit towards future bookings.

22. Accidents, Personal Injury, Property Damage and Insurance Cover
- 1) Record the location, date and time of the accident.
- 2) Record the names, addresses and vehicle registrations of third parties and any witnesses.
- 3) Record the name of the other party’s insurance company.
- 4) Not accept blame or liability or insist the other party is at fault.
- 5) Report the accident to the police within 24 hours of the accident; and
- 6) Notify ARV within 24 hours of the accident.
- 7) Complete the ARV Accident Form
- You have not paid the applicable liability reduction option amount stated on the rental agreement.
- You have breached or caused any other person to have breached any term of this agreement including the special conditions of the rental agreement.
- You are not covered under any other policy of insurance.
- You have provided such information and assistance as may be requested and, if necessary, authorising ARV’s insurer to bring, defend or settle (at its sole discretion) legal proceedings but ARV shall have sole conduct of the proceedings.
- If cover is extended to you by our insurer
- You authorise our insurer to commence, defend or settle, at its sole discretion, any legal proceedings, our insurer will have sole conduct of any proceedings; and any such proceedings shall be brought or defended in your name.

24. Full Responsibility
- Loss or damage caused by or resulting from a breach of the terms of this agreement by the hirer (including any authorised driver).
- Damage caused to the vehicle by not driving in a prudent and cautious manner.
- Damage caused to the vehicle by driving on unsealed roads or beach driving.
- Damage caused to the vehicle in any way by part or total water submersion including in flood water, river water, salt water, or any other source of water.
- Damage caused to the vehicle by the hirer’s wilful conduct or reckless e.g. sitting or standing on the bonnet or roof of the vehicle.
- Damage caused to the vehicle due to use of incorrect or contaminated fuel.
- Damage caused due to the use or misuse of snow chains.
- Damage or loss caused to any personal belongings.
- Damage to the awning, overhead (roof) or under-body of the vehicle.
- Damage caused to the vehicle because the Hirer has failed to perform tyres checks and maintain all fluid and fuel levels or failed to immediately rectify or report to us any defect of which you become aware.
- All costs to replace keys which have become lost, broken, damaged, stolen or of retrieval of keys which been locked in the vehicle, or where the vehicle has been stolen due to it being unlocked.
- Loss or damage caused where it is deemed by local authorities to have been careless or wilful in failing to comply with any legislation or regulation controlling vehicular traffic, resulting in damage to the hired vehicle and/or Third-Party vehicle or any other property.
- Damage caused by the hirer’s failure to take reasonable measures for the safety of the vehicle, its parts or accessories, or failure to comply with all restrictions on the use of the Vehicle or otherwise abuse or misuse of it.
- The cost of recovering the vehicle in the event it becomes stuck or bogged in wet ground, sand or mud.
25. Financial Obligations and Payment of Charges
- All rental charges specified on the Rental Agreement.
- All charges claimed from ARV in respect of parking or any other traffic violations incurred during the period of hire or until such later time as the vehicle is returned to ARV.
- The applicable security bond in the event of an accident.
26. General Provisions
27. Limit of Liability and Indemnity
Without limiting any other term of this Agreement, to the extent that ARV is permitted under New Zealand law to limit its liability, the aggregate of ARV liability to the Hirer is limited to an amount not exceeding the amount paid by the Hirer to rent the Vehicle.
28. Breach of Contract/Termination
- The hirer fails to comply with any of the material terms and conditions of this Agreement,
- The hirer has obtained the vehicle through fraud or misrepresentation;
- If the Vehicle is damaged; or
- In the reasonable opinion of ARV and/or the NZ Police, the driver of the vehicle does not have sufficient skill or experience to operate the vehicle in a safe manner or the safety of the passengers or the vehicle is at risk.
In such an event the hirer will:
- (a) not be entitled to any refund the rental charges whatsoever; and
- (b) be responsible for the payment of any towing costs to return the vehicle to the agreed return location.
